In fact, the administrator who oversaw the writing of the rule, himself a trial lawyer, has said publicly since he assumed his position that terms like "unfair, unreasonable or undue prejudice" -- the exact words in the rule -- are "a plaintiff lawyer's dream".
But it will take more than a mere re-writing of the rules.
