Last week, crown prosecutors abandoned the prosecution under the Official Secrets Act of a 29-year-old translator, Katharine Gun, who admitted leaking to a British newspaper the top-secret request from American intelligence to spy on United Nations diplomats.
The top secret budget request for the current fiscal year was obtained by The Washington Post from the former National Security Agency contractor Edward J. Snowden and published in part on its Web site on Thursday.
The material, which was not marked as classified at the time it was sent and received by Clinton on her private, unsecured server, was upgraded to top secret at the request of a team of reviewers from the intelligence community.
On January 29, the State Department said 22 emails sent or received by Clinton had been upgraded to top secret at the request US intelligence agencies and would not be made public.

Frequently, evidence obtained abroad is classified "secret" or "top secret" as an initial matter, but it can be declassified for use in a federal trial at the request of the prosecutor, after a more thorough examination.
