This morning, Judge Jackson did file an order saying "the court reserves ruling on Microsoft's motion" of a stay pending appeal "until such time as a timely notice of appeal is filed".
"For want of a signature on a timely notice, the appeal is not automatically lost," Justice Ginsburg said in her opinion for the court reversing the Sixth Circuit.
