He quotes a prosecutor who believes that a military commission would have allowed the statements because of "lapse in time, change of place, or change in identity of the questioners between the statement sought to be admitted and any prior questioning of the accused" — a debatable proposition — but doesn't really say why distance from the "prior questioning" would be needed.
