The New Jersey Plan contained a provision that: "[N]o person shall be liable to be tried for any criminal offense, committed within any of the United States, in any other state than that wherein the offense shall be committed.... ..
Further, more generally, § 14 of the Crimes Act of 1825 provided that "the trial of all offences which shall be committed upon the high seas or elsewhere, out of the limits of any state or district, shall be in the district where the offender is apprehended, or into which he may first be brought".
