The Appellate Division of the State Supreme Court ruled that Justice Marcy L. Kahn had improperly prevented defense lawyers from asking his accuser about her prior lawsuits, her finances and what the lawyers contended was her false testimony in a landlord-tenant case.
The tenants' case is still pending.
The New York City Housing Authority, with 400,000 residents the city's largest landlord by far, says it will decide what rent to charge tenants case by case.
A trial in the tenants' case — which has the support of the Buildings, Fire and Housing Preservation and Development Departments — has been completed, but the Housing Court judge has not ruled yet.
On Monday, the tenants' case goes to federal court, where they will argue that officials have consigned the neediest residents to the most distressed neighborhoods.
State Supreme Court Judge Eileen Rakower issued a temporary restraining order on Friday barring Carnegie Hall from further action until a hearing on the tenants' case on Sept. 17.
Nor is the housing contingent on a contract with the state to undergo rehabilitative programs or counseling--the state simply requires residents to be, "good stewards of their personal and shared housing areas and maintain good relations with other tenants, case managers, and property managers".
Her mother was a volunteer mediator of landlord-tenant cases and other disputes for Cluster, a community service organization in Yonkers.
That law, he said, was intended to make the administration of landlord-tenant cases more efficient, less time-consuming and less costly to the parties.
In 2006, he earned the same salary, and according to disclosure forms, he made at least $250,000 from the sale of the same property in Florida and at least $5,112 from investments. Herbert Rubin, a partner at the law firm Herzfeld & Rubin, which handles many landlord-tenant cases, said the property sale and investment income would count toward the $175,000 cap under city rent regulations.
