MySpace has received notices of infringement about Project Playlist at different times from several of the major music companies currently suing Project Playlist.
EMI Music, one of the three major labels which was suing Project Playlist for copyright infringement, dropped out of the litigation and is announcing today that it has licensed its entire catalog to the service instead.
That alone could help to absolve Kickstarter from any legal action from backers who want to sue when projects go south, the product never ships, and their money effectively disappears.
The group, Develop Don't Destroy Brooklyn, and 15 co-plaintiffs sued the project's developer, Forest City Ratner Companies, and the state agency sponsoring the project, the Empire State Development Corporation, in January after the agency retained an environmental lawyer, David Paget, who had earlier advised the developer on the project.
Three years later, the patent claims were dismissed, but as Inside Higher Ed details, "following several months of intense criticism," Blackboard was forced to issue a "patent pledge" in 2007, "promising not to sue Open Source projects for patent infringement".
Now he is suing the project, seeking compensation for the intellectual property rights he claims to have generated for Eden and for the time and expenses he invested in the scheme.
In McCarthy's district, Bakersfield and Kern County have sued the project, though a recent federal regulatory ruling may make the suits moot.
