As the HKSAR government has yet to have sufficient information to process the request for provisional warrant of arrest, there is no legal basis to restrict Mr. Snowden from leaving Hong Kong.

Although the red notice does not amount to an arrest warrant, an Interpol spokesman said that often they were interpreted as a "valid request for provisional arrest" especially if the two countries, such as Sweden and the UK, have extradition treaties.
"The true object of this request for provisional measures may be exposed as this: Timor-Leste seeks to prevent Australia taking steps properly available to us under our domestic law, law which is consistent with international law, to protect ourselves from a threat to security apparently posed by a disaffected former officer".
"A decision on request for provisional measures is likely to be issued on Monday 18 August around 18 00 (Swiss time)," secretary general Matthieu Reeb added.
However, the statement goes on: "As the HKSAR Government has yet to have sufficient information to process the request for provisional warrant of arrest, there is no legal basis to restrict Mr Snowden from leaving Hong Kong".
Mr. Leung has noted that Hong Kong had posed questions to the United States last Friday about the details of an American request for his provisional arrest, which had been made six days earlier.
