If no petition for rehearing and/or rehearing en banc is made, or if it's made and denied, or if it's granted, after it's decided, then a party can ask the Supreme Court to hear the case.
In March of 2014, the Court denied a Petition for Rehearing filed in February of 2014, letting the Ninth Circuit's decision stand, along with the reasonable suspicion standard it created.
Jackson agreed that the petition for rehearing should be denied, but refused to give approval to Black's participation in the case.
"We believe this case is too significant to let a split decision stand, and we will file a petition for rehearing with the Supreme Court," he said.

The appeals court summarily reversed the conviction and, granting the government's request, set the case for rehearing before the full court.
Petitions for rehearing are very seldom granted.
But they fell just short of the votes needed for rehearing.
