–The Department of Immigration is addressing the issue of non-refoulement by simply allowing asylum seekers in to Australia so they can be free and contributing members of society.
Turkey has also "openly flouted the principle of non-refoulement by blocking Syrian asylum seekers at its border," according to HRW, denying entry to up to 100,000 people fleeing fighting as of April 18 and even shooting at some of them.
The: Principle of non-refoulement, as interpreted by the ECHR, essentially means that states must refrain from returning a person (directly or indirectly) to a place where he or she could face a real risk of being subjected to torture or to inhuman or degrading treatment (Hirsi, 2012, para. 34).
Italy's next government put an end to this "push-back" approach, technically known as refoulement, in 2012.
"It is clear refoulement to send someone back home, when they have been found to be a refugee; especially to places where there is an active war occurring.
It is refoulement to return a very sick person to a place where there is no adequate healthcare and they will only deteriorate.
Article 33 of the convention prohibits "refoulement" of refugees – ie removal to places or countries where their lives or freedom would be at risk on account of their race, religion, nationality, membership of a particular social group or political opinion.
HRW argues that this dynamic is technically a breach of international law, since the 1951 refugee convention forbids the return or "refoulement" of refugees to countries where they may be at risk.
Although it theoretically provides a frame protecting some migrant groups, such as pregnant women or minors, and limiting refoulement to the borders, those provisions do not appear to be thoroughly implemented yet [ 13, 14].

This crisis is an opportunity for Europe to uphold its commitments to the principles of the Convention on the Rights of the Child, and the 1951 Convention on Refugees and its Protocol; to respect basic human dignity and the principle of 'non refoulement'; to uphold the foundation values of the European Union and the core principles of its Human Rights legislation.
