We see no sound reason to depart from this rule and to grant greater protection in this regard to commercial tenants than that afforded to residential tenants, especially since we and other jurisdictions see no rational distinction between residential and commercial leases in this regard.
There is no showing that the situation of foreign corporations, writing casualty insurance contracts in Indiana, is so similar to that of domestic corporations as to preclude any rational distinction between them as regards the time required for negotiating settlements of claims and the determination whether suits upon them should be prosecuted within or without the state.
So far as the need to be free from prosecution by a prejudiced grand jury is concerned, there can be no rational distinction between the need of the man who is not yet in custody and the need of the man who is in jail or on bail, 13 particularly where as here the grand jury was called for the specific purpose of examining into petitioner's activities and was so instructed.

Yet another way of denying the gap is to claim, along with Descartes, that the distinction between an attribute and the substance is only a rational distinction.
Descartes calls the distinction between attributes of the same substance, and between a given attribute and its substance a "rational distinction," (Principles, I, §62, CSM, I, p. 214, AT 30) and so, insofar as Thought and Extension belong to the same substance for Spinoza, they would be, in Descartes' terminology, rationally distinct.[8] Spinoza however, says that they are "really distinct".
An alternative mentioned above that has been suggested is to deny the gap between the attributes and the substance by claiming that, along with Descartes, Spinoza holds there to be a rational distinction between them, that is, in reality they are identical (Shein, 2009).
I, q. 4, he summarizes the views of three authors: Godfrey of Fontaines, according to whom the distinction is only conceptual (secundum rationem); Henry of Ghent, for whom esse is only intentionally different from essence, a distinction that is less than a real distinction but greater than a rational distinction; and finally, Giles of Rome, for whom esse is one thing (res), and essence another.
