For purposes of this title, an alien individual who has not established a taxable year for any prior period shall be treated as having a taxable year which is the calendar year. he shall be treated as a resident of the United States with respect to any portion of a taxable year which is within such calendar year.
Notwithstanding the provisions of such subparagraph (A), an individual who made such an election under such section 8339 k)(1) (or prior provision) shall not be required to make the deposit described in such subparagraph.
Except under unusual circumstances recognized by the law of evidence, evidence of prior offenses shall not be admitted on the issue of determining whether the person charged has committed the offense.
The level of consideration given the factor of prior experience shall not vary from the level of consideration given such factor during fiscal years 1994 through 1997, except that grants made under section 1070a 18 of this title shall not be given prior experience consideration.

The authorities set forth in this section which were available to the Secretary immediately prior to November 15 , 1990 shall after November 15 , 1990 be available to the Secretary of the Interior.
Any agency agreement executed prior to October 19 , 1976 shall be deemed amended to the extent necessary to conform such agreement or order to the provisions of this paragraph.
