The 2012 law requires the Medicaid office and other state agencies to implement alternatives to the prevailing fee-for-service reimbursement scheme.
Legislative leaders seem determined to end within five years the prevailing fee-for-service system, in which doctors and hospitals are paid for the volume of care they provide whether or not it is high quality or needed.

Because insurers typically reimburse patients for only 70 to 80percentt of the "reasonable and customary" cost of medical services when they visit doctors outside the insurer's designated network of physicians, the patient can get shortchanged if the insurer understates the prevailing local fees.
Mr. Cuomo's investigation found that the industry database's determination of $72 as "reasonable and customary" might have been an unfairly low assessment of the actual prevailing local doctors' fees.
"It's kind of sad that those who have followed the law, paid an inordinate amount of money to follow the law by paying attorneys' fees, prevailing wage and following the rules, are those who are getting hurt," said Don Mooers, an immigration lawyer working with Save Small Businesses, a group of small business owners lobbying for the cap to be lifted.
The concern of this discussion, however, is different: regardless of the relative values for evaluation and management versus procedural services, the prevailing system of fee-for-individual-service offers no economic incentives for clinicians to efficiently organize the care delivered by other providers.
The issue of who pays the prevailing party's attorney fees in such cases is significant, lawyers say, because it is typically more difficult for tenants to pay high-priced lawyers than it is for landlords.
This bill would also provide that an NPE would have to pay the attorneys' fees of a prevailing defendant if the court found that the NPEs assertions were unjustified, a less extreme attorney fee shifting measure than the SHIELD Act.
The court shall award costs and attorney's fees to a prevailing plaintiff in litigation filed pursuant to this subsection or subsection (f).
