The three-judge panel of the United States Court of Appeals for the District of Columbia Circuit said there was no need to issue an emergency order sought by the White House to block pretrial information gathering, or discovery, in the suit brought by Judicial Watch, a conservative group that has been a persistent opponent of Mr. Clinton.
Because of the C.I.D.'s slipup, it appeared, practically all the pretrial information obtained by the investigators could be successfully challenged in court by the defense — which meant that Manuel's confession of guilt would be inadmissible as evidence, and without that the government's case was as good as emasculated.
The defense had said the case would involve investigations in Yemen, Pakistan and Afghanistan and multiple pretrial hearings involving classified information as well as hearings to suppress evidence.
The violations include failing to disclose all required information in pretrial proceedings and failing to follow the court's 2014 order to "quietly" collect audio and video recording devices from deputies, according to court filings.

A frequency analysis revealed six categories of primary information needs at pretrial with the following hierarchical structure: likelihood of a cure (28%), treatment side effects (15%), coping strategies (13%), diagnostic tests (12%), treatment duration (7%) and aetiology (4%).
Joanna Baltes, a prosecution lawyer, said the detainees could be removed from pretrial evidentiary proceedings if the classified information will not be used as "affirmative evidence" against them.
In pretrial hearings at Fort Meade, Md., basic information has been withheld, including dockets of court activity, transcripts of the proceedings and orders issued from the bench by the military judge, Col. Denise Lind.
The requested visit was one of several issues raised at a pretrial motions hearing that focused on information that could become a central focus if the defendants are eventually convicted and they face the possibility of a death sentence.
These days, that number has fallen to 13. Judges spend the rest of their time doing such things as supervising the exchange of information between parties, deciding pretrial motions and urging or approving settlements and plea bargains.
