A Jamie Heiberger, a Manhattan lawyer who specializes in landlord-tenant matters, says that under state law, a landlord may apply for High Income Deregulation when the legal rent for an apartment reaches $2,500 and a tenant's household income exceeds $200,000 — as reported on the tenant's New York State Income Tax Returns — for the preceding two calendar years.
Under that law, which was amended in 1997, an apartment can be decontrolled when the rent is $2,000 or more and the annual income of the tenant exceeds $175,000 for two years preceding the landlord's petition for decontrol.
(The same decontrol threshold increase was effective on July 1 for occupied rent-regulated apartments in which the tenant's household income was $200,000 or more for the preceding two calendar years).
This means that in most cases, tenants can get refunds for overcharges for only the preceding four years.
Adjusted for preceding hospitalizations, care level, cause of death and multimorbidity, a low educational level, living alone or being tenant as well as a low care level at the admission time increased the risk for longer terminal stays.
Rent-stabilized tenants may not sublease their apartments for more than two years of the four years preceding the end of a sublease.
The preceding sentence shall not be construed to limit or deny a deduction for depreciation under section 167(a) by a cooperative housing corporation with respect to property owned by such a corporation and leased to tenant-stockholders.
