Setting precedent to Hardware's sentencing is Jason Mack, who similarly to Hardware, masturbated on top of a 14-year-old girl riding the subway but was dismissed with only a misdemeanor sex abuse charge because a judge ruled Mack never threatened his victim with violence.
At least for this Circuit, especially given our prior 1-800 precedent, which applied the second sentence of the definition to infringement, the latter solution, according a different scope of application to the two sentences of the definition, seems to be preferable.
As the D.C. Circuit's citations to precedent indicate, fact-finding at sentencing has long been under a preponderance of the evidence standard.
The Supreme Court's precedents have established that a sentence can be so disproportionate to the offense as to violate the Eighth Amendment's prohibition against cruel and unusual punishment.
"We need brave individuals to hold the government accountable for its actions at home and abroad and we call upon this court to overturn the dangerous precedent of Chelsea Manning's excessive sentencing".
"These appalling sentences are without precedent in Europe," EARA Executive Director Kirk Leech said in a statement distributed by the United Kingdom's Science Media Centre.
