The adoption placement order was refused.
District judge McPhee's decision to make a placement order was upheld by a circuit judge and in May 2013 by the court of appeal.
The number of children in all forms of care stands at 68,000, and at the end of March 2013 there were about 6,000 children with a placement order waiting to move in with a family.
In a damning assessment of Gloucestershire county council's failures, Judge Stephen Wildblood QC said he had no confidence the authority would "take any effective steps to support any family relationships" and was making the rare decision not to issue a placement order.
"So the prospective adopters have to take on a lot of risk – maybe the court will direct the child to go back or something won't go quite right with the final placement order – and they [the adopters] have to be worked with very closely by social workers to accept that risk and manage it appropriately with the child concerned".
He also noted that the preferential placement order required under § 1915(a) could be changed by the tribe under § 1915(c) and a tribe could, by resolution, grant the absentee father a place in preferential placement.

The number of placement orders granted by courts was also down from 1,650 to 750.
Some of the children who may previously have been made the subject of adoption or placement orders are now thriving in the care of family and friends.
He said that care orders with a plan for adoption, placement orders and adoption orders are "a very extreme thing, a last resort" where "no other course is possible in the child's interests".
The most recent figures, published last September, show that the number of children with adoption placement orders is now roughly the same as the number of adoptive parents waiting for a match.
But following two landmark appeal court cases, the brakes are firmly on: family judges are applying the full rigour of statute to local authority evidence when applications are made for adoption placement orders.
