FROM THE DISSENT By Chief Justice Rehnquist I agree with the Court that, "in the limited circumstance when drawing racial distinctions is permissible," the government must ensure that its means are narrowly tailored to achieve a compelling state interest.
Even in the limited circumstance when drawing racial distinctions is permissible to further a compelling state interest, government is still "constrained in how it may pursue that end: [T]he means chosen to accomplish the [government's] asserted purpose must be specifically and narrowly framed to accomplish that purpose".
It will also need to continually articulate the distinction between political speech permissible under such regimes as the Universal Declaration of Human Rights and truly illicit online activity (like child pornography, cyber crime, and terrorism).
In particular, a distinction should be made between permissible roles and mandated responsibilities, and between types of NHPs.
Chief Justice William H. Rehnquist, writing three years ago in his book "All the Laws but One: Civil Liberties in Wartime," said that "in time of war the government's authority to restrict civil liberty is greater than in peacetime," and that "distinctions that might not be permissible between classes of citizens must be viewed otherwise when drawn between classes of aliens".
While the committee for privileges makes the clear distinction between advocacy, which is banned, and advice, which is permissible, it appears that public expectations of how a member of the House of Lords ought to behave differ from what the rules allow.
Simply put, distinctions between corporations and human beings are no longer permissible and limitations on corporations' political speech are unconstitutional.
The PCC added that a distinction should be drawn "between critical innuendo which, though perhaps distasteful, was permissible in a free society – and discriminatory description of individuals, and the code was designed to constrain the latter rather than the former".
Therefore, Quinn's account of the moral significance of the distinction between direct and indirect agency could not be invoked to explain why it might be permissible to kill in self-defense or to sacrifice one's own life to save the lives of others.
But ethicists bring clarity and richness in argumentation, distinctions and nuance – they go beyond the generic "right" and "wrong" to explore what is permissible or impermissible, obligatory or supererogatory (desirable but beyond the call of duty).
