The band said in a posting on its MySpace page this week that the government told the band on Feb. 28 that officials were revoking a performance license and that two shows scheduled for early April in Beijing and Shanghai were being canceled.
Recordings were especially important to Monk at the time because, as a result of trumped-up drug charges, he had lost his cabaret card (in effect, a New York City performance license) and couldn't play in any venue that served alcohol — i.e., jazz clubs.
As Ars Technica eloquently pointed out, the claim is ridiculous because after all one doesn't need a public performance license to drive around town in a convertible with the radio on.
Popular songs are valuable to own because of all the royalties they collect: whenever the song is played on a streaming service, downloaded from iTunes, or covered on YouTube (a mechanical license), played over radio or in a grocery store (a performance license), played as soundtrack over a movie or TV show (a sync license), and for other uses.
Note: If you are playing a commercial venue such as a nightclub you must have a performance license for your music or music that is sold to DJs as "promo only" or with an included performance license.
The MPAA's hounds argued that Zediva was serving up a public performance and did not have the proper pay-per-performance license.
Mr. Amenita said that a number of sites have secured performance right licenses.
