At the same time, the state's parole failures have dropped by 39 percent.
The Orange police had issued an arrest warrant for Mr. Everett for aggravated assault with a firearm, he said, and the Essex County Sheriff's Office had put out warrants for violation of parole and failure to appear in court for crimes ranging from weapons possession to drug sales.
But what's at stake is far more than just parole procedure: failure to provide right to counsel could directly contribute to a growth in California's prison system from increased parole revocations.
The switch came in reaction to the explosion of violent crime in the late 1960's and early 1970's and an unusual agreement by liberals and conservatives that discretionary release on parole was a failure.
"If the minister oversees a system that can send families with vulnerable young children to the same motel as criminals released on parole, then the failure of the system falls squarely at his feet," she said.
Philip Stephen Fuoco, a lawyer who represented inmates in a class action suit against the parole board for failure to hold required hearings for more than 5,800 prisoners, said last week that it was important to maintain a separation between the parole board and the prison administrators.
Her record contributed to her failure to get parole.
Raul Morales has a better chance, thanks to a new official awareness that the prison and parole systems are leading to failure.
"The failures of federal parole authorities in handling Garrido's case management are as outrageous and inexcusable as they are numerous," the complaint reads.
More than half of American prisoners' "recidivism" is due to technical parole violations: curfew violations, reporting failures, failed urine tests or for minor offenses.
Since a single test failure can be a parole or probation violation, every 60 days the devices are calibrated to make sure they are working properly, Mr. Warner said.
