Mr. Fitzgerald, whose other high-profile prosecutions include public corruption charges against former Gov. George Ryan and a C.I.A. leak case against I. Lewis Libby Jr., the former chief of staff for Vice President Dick Cheney, said he would consider other government work, but ruled out running for office.
His defence barrister, Richard Horwell QC, said Clifford should not be made a scapegoat for other failed prosecutions including those of the Coronation Street actor William Roache, MP Nigel Evans, and the DJ Dave Lee Travis.
Meanwhile, other categories of federal prosecutions, including gun trafficking, public corruption, organized crime and white-collar crime, declined over the same period.
Military defense lawyers said that although the ruling was limited to one case, they expected the issue to be raised in other cases, potentially delaying prosecutions, including the death-penalty prosecution of six detainees at Guantánamo Bay, Cuba, for the Sept. 11 attacks.
The Ukrainian government needs to address these selective prosecutions, including the case of former Prime Minister Yulia V. Tymoshenko and other former senior officials.
"HMRC needs to increase the number of investigations and prosecutions, including wealthy tax evaders, and publicise this work to deter others from evading tax," the report said.
Other witnesses to testify for the prosecution include a BBC correspondent, Jacky Rowland, who saw the prison compound and a doctor who attended wounded inmates.
A report by the Centre for Social Justice earlier this year identified other barriers to prosecution including language and culture, victims' fear of reprisals from their traffickers and the fear of shame for their families – both in cases of UK and non-UK nationals who have been trafficked.
Other witnesses for the prosecution, including several of Sumaji's neighbours, testified that the driver could not have committed the murder because he was at home on the night of 13 August.
That, of course, would cause trouble in other prosecutions where "material support" is a charge, including the case against Khalid Shaikh Mohammed and four others accused of helping plan the Sept. 11 attacks.
