The court set Monday morning for arguments on Gov. George W. Bush's appeal of the Florida Supreme Court ruling that ordered manual recounts across the state of ballots that initially showed no vote for president.
The question that the justices agreed to hear -- whether, by ordering manual recounts to be included in Florida's certification, the state Supreme Court has usurped the role of its legislature in setting electoral procedures -- seems to turn fundamentally on the meaning of state law.
The Circuit Court correctly held there was no factual or legal basis to order a manual recount.
In Beckstrom, "appellant moved the court to order a manual recount of the absentee ballots.
"Nurses take pride in their work, are good at following orders and manuals, and they're customer service oriented".

Following this logic to its conclusion would require a circuit court to order partial manual recounts upon the mere filing of a contest.
If the United States Supreme Court rules that the Florida Supreme Court was wrong to order a manual recount of the "undervote" in Florida, Vice President Al Gore should concede the election.
In other words, if you're going to order the manual review of the ballots, the issue is what ballots are contested, and second, is there a judicial review of those ballots?
I also agree with the trial judge's conclusion that in a statewide election the only way a court can order a manual recount of ballots that were allegedly not counted because of some irregularity or inaccuracy in the balloting or counting process is to order that the votes in all counties in which those processes were used be recounted.
Finally, in order to manual inspect the results obtained by the software, files containing the single-base coverage on each chromosome and/or scaffold of the genome are generated.
