"The voucher program at issue constitutes the type of 'direct monetary subsidies to religious institutions' that Justice O'Connor found impermissible," the Sixth Circuit judges said.
"The plurality opinion foreshadows the approval of direct monetary subsidies to religious organizations, even when they use the money to advance their religious objectives," Justice O'Connor said.
New York's proposed law would affect some, although not all, of the businesses that roost in malls and industrial areas that are deeply fertilized by city tax and monetary subsidies.

They will have to signal their willingness to fully separate their farm subsidies from production, reduce the monetary value of those subsidies to a reasonable level and significantly lower barriers to agricultural imports.
If there is a large supply of workers in the informal economy the supply of low-skill labor will be quite elastic, leading to a situation where employment gains (in the formal sector) are large, but there is little effect on wage rates and most of the monetary value of the subsidy is captured by employers.
