But the settlement still shields them from state and federal civil lawsuits for most foreclosure abuses, including the wrongful denial of loan modifications, excessive late fees that enriched the banks but could make it impossible for borrowers to catch up on late payments, and conflicts of interest that led banks to favor foreclosures over modifications.
As a result, many victims of foreclosure abuses like bungled loan modifications, deficient paperwork, excessive fees and wrongful evictions will most likely get less money.
At critical moments of agenda re-set, re-examination, and modification of existing maternal fee exemption policies, policy agenda advisers – acting as policy champions – took decisions within boundaries of previous policy content, implementation challenges, such as inadequate funds, as well as current demands and expectations.
"Magically, when we do that, we will get an offer of a modification and those fees often go away," Mr. Bedard says.
In addition, banks would have to reward their employees for pursuing modifications over foreclosures, while late fees would be curtailed.
