A person may be considered to be engaged in the business of making, by means of the World Wide Web, communications for commercial purposes that include material that is harmful to minors, only if the person knowingly causes the material that is harmful to minors to be posted on the World Wide Web or knowingly solicits such material to be posted on the World Wide Web.
"We have been continually working to deal with pornographic content, and material that is harmful to children, on the Web in China," the statement said.
The court followed a remarkably similar path in its inconclusive decision involving the Child Online Protection Act, which criminalizes the commercial posting of sexually explicit material that is "harmful to minors".
A second, more equivocal decision addressed the Child Online Protection Act of 1998, which makes it a crime to place material that is "harmful to minors" on a Web site available to those under age 17.
The court reasoned that in the global context of the Internet, the new law's use of "contemporary community standards" to identify material that is "harmful to minors" placed an impermissible burden on speech that deserved constitutional protection.
Children and the Web In another First Amendment case, the justices today accepted an appeal by the Bush administration and agreed to decide the constitutionality of a federal law barring the use of the Web for "commercial purposes" in a way that makes sexually explicit material that is "harmful to minors" available to those under 17.
The statute, which imposes prison sentences and fines of up to $100,000 for placing material that is "harmful to minors" on a Web site available to those under the age of 17, was passed in 1998 and has never taken effect.
The law carries penalties of a $50,000 fine and six months in jail for those who knowingly "make any communication for commercial purposes" on the World Wide Web "that is available to any minor and that includes any material that is harmful to minors," those younger than 17.
