By making it clear that OCR would be aggressively pursuing harassment claims, by mandating extensive changes to many universities' due process protections, but not requiring universities to adopt a uniform standard for harassment, OCR has supercharged the power of existing campus speech codes.
"This standard was passed in 2004, after many years of due process," said Robert H. Attmore, chairman of the Governmental Accounting Standards Board, an independent body known as GASB that sets the rules for state and local governments (and pronounced GAZ-bee).
"One rape is one too many, one assault is one too many, one aggressive act of harassment is one too many, one person denied due process is one too many," DeVos told the crowd at George Mason.
Many defence lawyers believed due process was sacrificed for expediency in the rush to process the first wave of riot cases, with complaints of "panicky" judges declining to assess cases on their individual merit, implementing what appeared to be a blanket policy of declining bail and, in the words of one lawyer, dispensing "conveyor-belt justice".
In many cases, the basic due process of a bond hearing would have prevented months or years of such arbitrary detention and saved countless taxpayer dollars.

Criticism also remains high that the American military detains too many people, deprives them of due process and holds them too long, even if innocent.
