Between the cruel original bill, and the harsh amendments that will be added to the bill on Tuesday (no Democratic improvements will be allowed), H.R. 1215 would quite literally immunize the health care industry for most kinds of misconduct, from horrendous medical malpractice in hospitals, to nursing home abuse and neglect, to sexual assault by doctors.
Charles Pinckney, of South Carolina, and Gouverneur Morris, of Pennsylvania, moved to strike out a proposed phrase stipulating that the President could be removed "on impeachment and conviction for malpractice or neglect of duty".
An approach to selected legal issues: confidentiality, mandatory reporting, abuse and neglect, informed consent, capacity decisions, boundary issues, and malpractice claims.
The caps would apply broadly to all manner of medical malpractice, including errors in surgery, side effects from unsafe drugs, abuse and neglect in nursing homes, and sexual assault by doctors.
This bill is so outrageously broad that it covers not only cases involving medical malpractice, but also cases involving unsafe drugs and nursing home abuse and neglect.
Many individual acts of cruelty and neglect by slaughterhouse staff, hauliers and farmers are also documented, alongside malpractice that increases the risk of food poisoning.
In a medical malpractice bill passed by the House this year, noneconomic and punitive damages available in nursing home abuse and neglect cases would be severely restricted.
