But, as we could see earlier, nothing can be a human nature existing without its individuating conditions, although any individualized human nature can be thought of without thinking of its necessarily conjoined individuating conditions (just as triangular shape can be thought of without thinking its necessarily conjoined conditions of being isosceles or being scalene).
Thus, insofar as the formally same nature is actually considered by a human mind in abstraction from these individualizing conditions, it is a universal, a species, an abstract object of a mental act whereby a human mind conceives of any individualized human nature without its individuating conditions.
Accordingly, there is no need to assume that there is anything in the individual humans, distinct from these humans themselves, a common yet individualized nature waiting to be abstracted by the mind.
In such situations, the formal element of drama and tragedy, which involves the paradoxical relation between highly universalized form and highly individualized content, mirrors the paradoxical relation between form and life that individuals experience in their own relation to society.
That is because New Fisa no longer requires individualized targets in all surveillance programs.
Individualized warrants are required only when the target of the surveillance is a US person or the call is entirely domestic.
But even under the law, no individualized warrant is needed to listen in on the calls or read the emails of Americans when they communicate with a foreign national whom the NSA has targeted for surveillance.
But even in such cases, the NSA often ends up intercepting those communications of Americans without individualized warrants, and all of this is left to the discretion of the NSA analysts with no real judicial oversight.
When the original Fisa law was enacted in 1978, its primary purpose was to ensure that the US government would be barred from ever monitoring the electronic communications of Americans without first obtaining an individualized warrant from the Fisa court, which required evidence showing "probable cause" that the person to be surveilled was an agent of a foreign power or terrorist organization.
As a result, under the FAA, the NSA frequently eavesdrops on Americans' calls and reads their emails without any individualized warrants – exactly that which NSA defenders, including Obama, are trying to make Americans believe does not take place.
With the ability to assess risks at the individual level and predetermine winners and losers, each individual will, in essence, enter into a savings program that covers lifetime disaster costs with an individualized monthly premium.
