It is recommended to replace the proposed indicator by a more sophisticated indicator referring to the relation between energy expenditures for electricity and heat of low-income households and the essential expenditures for the essential provision of these types of energy services.
In order to avoid declaring the provision unconstitutional, the court held that it "must be construed to apply only to expenditures for communications that, in express terms advocate the election or defeat of a clearly identified candidate for federal office".
