(1) No permit shall be required under this part for any person conducting activities on the public lands under other permits, leases, licenses, or entitlements for use, when those activities are exclusively for purposes other than the excavation and/or removal of archaeological resources, even though those activities might incidentally result in the disturbance of archaeological resources.
Also rejected as unrealistic was any rule which would require the defendant to demonstrate the impeachment value of the prior statements before disclosure, 8 and the Court held that entitlement to disclosure for use in cross-examination is 'established when the reports are shown to relate to the testimony of the witness.' Id., at 669, 77 S.Ct., at 1014.
