Steven T. Miller, the I.R.S. director of enforcement, said the study was skewed because it failed to take into account a surge in hours that I.R.S. agents spent working with businesses before they filed their returns to prevent errors or underpayments.
The legal standard for intoxication now applied in California and other states is.08, lower by half than the benchmark used by law enforcement before the study.
"In its application, that clause remains problematic because article 10 line 2 has many weaknesses and is understood differently by both the society and law enforcement officials," the study concludes.

City and federal officials said that the pool of inmates was too narrow to offer insight into enforcement strategy, and that the study did not consider key factors, like an inmate's criminal history, that influence the issuing of detainers.
Daniel J. Kaniewski, deputy director of the Homeland Security Policy Institute at George Washington University, points out that degrees in any number of disciplines — emergency management, law enforcement, engineering, even zoonotics (the study of the transmission of disease from animals to humans) — can lead to jobs in the field.
"We strongly question whether [such] expenditures... on law enforcement are legally permissible," the study said.
It is a predicament that stems from a lack of attention to the implementation and enforcement of workplace safety regulations, the study finds.
A risk-management strategy 24 proposes that matters of high risk and of intrinsic interest to law enforcement would be avoided in the study, that is, supply and distribution networks and participants' roles in them, matters related to other crimes not heard before a court or under investigation and/or matters related to any future planned crimes.
In one line that was particularly jarring given the report's authors, the study suggested, "Law enforcement or intelligence agencies may start to seek orders compelling Samsung, Google, Mattel, Nest or vendors of other networked devices to push an update or flip a digital switch to intercept the ambient communications of a target".
