Mr. ElBaradei said he had "emphasized to all the security authorities here that everything has to be done in due process," adding, "I would be the first one to shout loud and clearly if I see any sign of regression in terms of democracy".
"None of this is to say that Congress is free to disregard the Constitution when it acts in the area of military affairs," he wrote, and specifically cited questions of due process, but added, "the tests and limitations to be applied may differ because of the military context".
"Each case is unique and I have not seen any unfair interpretation of the rules or due process," he added.
"AquaBounty deserves regulatory due process," he added.
"What is unconstitutional is using money to detain and deprive an individual of due process," Burdeen added.
"I don't know the right answer, but I do know that as we work it out it's critical we be clear, transparent, consistent and respectful of Due Process," he adds.
Due to the unbalanced power dynamic between prosecutors and defense attorneys some innocent people choose to plead "guilty" rather than run the risk of being found guilty later on by the court, which typically penalizes you for seeking due process by adding additional criminal charges.
"I don't think we really cared about due process," the official added.
"The broader issue is that everyone -- foreign investors, minority shareholders and simple Russian citizens -- all want to feel comfortable with property rights and due process," Mr. Mazalov added.
Nor is the weight on this side of the Mathews scale offset by the circumstances of war or the accusation of treasonous behavior, for "[i]t is clear that commitment for any purpose constitutes a significant deprivation of liberty that requires due process protection," (emphasis added) and at this stage in the Mathews calculus, we consider the interest of the erroneously detained individual.
