The band Wilco cancelled its May 7 concert, calling the new law "thinly disguised legal discrimination".
Such exceptions to the general principle must be interpreted strictly, and national measures cannot constitute a means of arbitrary discrimination or disguised restriction on trade between Member States.
Under European law, countries are allowed to restrict imports on public health grounds but only if doing so does not constitute a "means of arbitrary discrimination or a disguised restriction on trade between member states".
The EFF also attacks the Telecommunications chapter for subordinating the security and privacy of users to the commercial interests of business — noting that the former are "only allowed to be taken into account if it can be established that they are not 'a means of arbitrary or unjustifiable discrimination or a disguised restriction on trade in services'".
"The E-Commerce chapter does not prohibit recourse to this option altogether, but imposes a strict test that such measures must not amount to 'arbitrary or unjustifiable discrimination or a disguised restriction on trade' — a test that would be applied by an investment court, not by a data protection authority or human rights tribunal," it adds.
Such measures shall not, however, constitute a means of arbitrary discrimination or a disguised restriction on trade between Member States.
3. The Commission shall, within three months of the date of receiving the notification provided for in paragraph 2, approve or reject the planned assessment after having verified whether or not it complies with the requirements referred to in paragraph 1 and whether or not it is a means of arbitrary discrimination or a disguised restriction on trade between Member States.
Exceptions to the WTO principles of nondiscrimination allow member states to adopt trade measures "necessary to protect human, animal or plant life or health" if they prove that such measures are necessary to meet a public health need and that they are not a disguised attempt to restrict trade or promote discrimination.
