The appreciating task becomes considerably more difficult when it must be based on a rather ambiguous Directive provision implemented in different ways by the member States.
To sum up, the High Court asks the Court to review, according to Article 234, paragraph 1(b), the validity of the Directive against provisions of Marpol 73/78, against provisions of UNCLOS, and against the general principle of legal certainty.
In the final part, an assessment will be made of the extent to which the Directive's provisions on working time are capable of adaptation in an increasingly heterogeneous working environment while preserving the Union's primary objective of protecting the health and safety of every worker.
