The court of appeal had previously issued a writ of habeas corpus – an ancient law that demands a prisoner is released from unlawful detention – requiring the UK to seek Rahmatullah's return or at least demonstrate why it could not.
In particular, Section 7 of Objective 10, "Search, Arrest, and Detention," requires agents have the "ability to execute a search warrant" and Section 7 of Objective 14, "Processing an Alien for Removal," requires a thorough understanding of "the appropriate notifications of rights" of undocumented persons.
IHMS has cautioned the government that people held for long periods in detention will require continuing mental health treatment after they are released.
Detentions should require reasonable suspicion.
Janet Farrell added, "The UK is the only EU country that hasn't signed up to the EU Returns Directive which places a maximum time limit on immigration detention and requires automatic judicial oversight of prolonged detentions, save for Ireland, which has its own time limit which is shorter than the Directive in any event.
With good behaviour, she will be released in a few weeks on home detention curfew, required to wear a tag.
In March, she said, cuts in state financing for the detention center required a sacrifice from its salaried employees: 10 percent of their paychecks.
