Once customer properties are known and capacity is fixed, firms set their money price so that it leads to an optimum mean waiting time, that is, a profit-maximizing one.
As an example, Levie said they had been talking to an insurance company that wants to fly drones into natural disaster areas to survey damage of customer properties "That ability to massively increase data inputs is incredible to any business that runs on information and obviously we want that to be [processed and stored] in Box," he said.
It may well be that no crimes were committed, but if this is so, it is time to seriously rethink how broker-dealers handle customer property.
In theory, customer property at a brokerage firm should be even more secure than money in a bank, because banks use fractional reserves, meaning that by design they have "used" a large part of the deposits, while customer property at a brokerage firm is supposed to be segregated in a special fund at a third-party custodian bank.
The trustee is also trying to recover "many hundreds of millions of dollars" in stolen customer property that he said the Fairfield Greenwich defendants received from Mr. Madoff in return.
"While we have made significant progress in identifying and distributing customer property held by U.S. depositories, the U.K. administrators' position will significantly affect, in the near term, my ability to return a substantial amount to U.S. customers dealing in foreign futures".
"The actions of management and other employees, along with lack of sufficient monitoring and systems, resulted in [commodity] customer property being used during the liquidity crises to fund the extraordinary liquidity drains elsewhere in the business, including margin calls on the European sovereign debt positions," the trustee report found.
The loophole that allowed MF Global to convert more than $1 billion in customer property to its own reckless bet on European debt is still in effect — although the Commodity Futures Trading Commission, which regulates futures and commodities brokers, said it had since pressured other firms to stop using it.
"This agreement supports my goal to expeditiously resolve outstanding conflicts with parties as we work to recover and distribute as much customer property as possible as quickly as possible, in a manner that is fair and consistent with the law," Mr. Giddens said in a statement.
"Since we believe that all of the assets that the business had were purchased with stolen money, we would argue that all of the proceeds from it — down to selling the paper clips on the desks — should be customer property," Mr. Harbeck said.
