Indeed, an important part of the statutory election scheme is the State's provision for a contest process, section 102.168, which laws were enacted by the Legislature prior to the 2000 election.
As stated above, one of the provisions of the contest statute, section 102.168 8), provides that the Circuit Court judge may "fashion such orders as he... deems necessary to ensure that each allegation in the complaint is investigated, examined or checked, to prevent any alleged wrong, and to provide any relief appropriate under such circumstances.
That would make the contest proceedings under Section 102.168, perversely, more permissive than the protest proceedings under Section 102.166, and would transform the ordinary counter of ballots in close elections from the county canvassing boards to the circuit courts in Florida.
As such, I would find that the selective recounting requested by appellant is not available under the election contest provisions of section 102.168.
I want to begin by going back to what I said in my opening yesterday, and this is to remind the court that this is, as the court well knows, a contest action under Section 102.168 of the Florida statutes.
