"construed to prohibit" is a correct and usable phrase in written English.
It is used to indicate that something could be interpreted or understood as prohibiting something else. Example: The law was carefully worded to avoid being construed to prohibit the freedom of speech, ensuring that citizens' rights were protected.
Section 8 of the bill unambiguously states that "[n]othing in this Act, or the amendments made by this Act, shall be construed to prohibit any expressive conduct protected from legal prohibition by, or any activities protected by the Constitution" -- which, of course, includes the First Amendment's right to free speech and exercise of religion.
