Through a performative historiographical approach the article unravels the dynamics of the proceedings, the role of experts and the co-construction of law, technologies and inventorship.
As we will demonstrate below, these provisions of federal law are not bases for invalidating a construction of state law by the state courts with which petitioner, or even this court, disagrees.
Section 5 is intended to "assure" states of "finality" in the determination of their presidential electors, and this court has already cautioned the Florida Supreme Court "against any construction of state law that Congress might deem to be a change in the law".

The Judiciary Act of 1789 authorized the Supreme Court to hear writs of error from the circuit courts and writs of error from the highest state courts in cases that involved the validity or construction of federal law.
By holding that Article II requires our revision of a state court's construction of state laws in order to protect one organ of the state from another, the chief justice contradicts the basic principle that a state may organize itself as it sees fit.
