Under the Cable Act of 1992, broadcasters have the right to charge retransmission consent fees for redistribution of their content, 47 U.S.C. § 325, and they typically earn hundreds of millions of dollars per month from retransmission arrangements with cable companies.
Currently, cable providers are required to carry local broadcast stations -- namely, ABC, CBS and NBC and Fox local affiliates – and generally pay billions of dollars in retransmission consent fees for that right.
"The critical legal difference is that Cablevision pays statutory licensing and retransmission consent fees for the content it retransmits, while Aereo does not," the company said in its filing.
Traditional broadcasters saw their advertising income slow, but they compensated by charging cable companies for carrying their content, a "retransmission consent" fee made possible, in 1992, by the Cable Television Consumer Protection and Competition Act.
Those so-called retransmission consent fees have become crucial for broadcasters since increased competition for eyeballs from cable channels and digital services such as Netflix have eaten away at their ratings and shrunk their piece of the advertising pie.
These consent fees, which are the city's going rate for private businesses to lease public real estate, were doubled or tripled in 2003, when the regulations changed.
Those deals -- known as retransmission consent fees -- have become a crucial source of revenue for CBS.
The results were boosted by increases in retransmission consent fees paid by pay-TV operators.
