The TRIPS Agreement requires all member countries of the World Trade Organization (WTO) to extend patent protection to "any inventions, whether products or processes, in all fields of technology, provided that they are new, involve an inventive step and are capable of industrial application".
In general, if the invention is new (i.e., it has not been disclosed to the public), is not obvious, and is capable of industrial application, then (with the exception of a few excluded categories) it should be possible to obtain a patent for an invention.
In accordance with Article 27§1 of the TRIPS Agreement, "patents shall be available for any inventions, whether products or processes, in all fields of technology, provided that they are new, involve an inventive step and are capable of industrial application", subject to the exceptions to patentability set out by national legal orders.
Citing Article 27 of TRIPS, which "generally mandates patentability where inventions are new, involve an inventive step (or are non-obvious), and are capable of industrial application (or are useful)" [ 5], Novartis claims that imatinib mesylate represented an "inventive step" in the drug development process due to its 30% increase in bioavailability [ 5].
