"It is ironic that much of the state's brief passionately spews sanctimonious verbiage on the separation of powers in the governmental branches," Justice Wiggins wrote, "and clear arm-twisting by the Executive on the Legislative permeates this entire process".
An inquiry was conducted into the branch by Justice White of the Supreme Court of South Australia, and the report was placed in Dunstan's hands on 21 December 1977.
In New Brunswick, where the securities commission functions as a branch of the justice department, fees brought in C$5.1m $3.3mm) last year, nicely covering the cost of the seven-person operation.
Geoff Gaul, a spokesman for the British Columbia criminal justice branch, said this decision was made after a prosecutor's review and a police investigation.
"A judicially imposed resolution would be an improvident intrusion into the internal workings of a co-equal branch of government," Justice McNamara said in his ruling.
Probation is a less well-known branch of our justice system, compared with, say, police and prisons, but that doesn't make it any less important.
The court should defer to the executive branch's assessment, Justice Breyer wrote, as "the Court has long recognized the president's special constitutionally based authority in matters of foreign relations".
In a statement, Ann Pfau, the state's chief administrative judge, said, "We look forward to studying the report and working with the bar, legislative leaders, the executive branch and criminal justice professionals on this critical issue".
The charges against Bertuzzi, for a hit March 8 widely shown on television replays, were filed by the criminal justice branch of the ministry of the attorney general; Bertuzzi was ordered to appear in court on July 9.
"It augurs well for things returning to a normalcy where the judges and courts are able to take a good look at what the government is doing, and consider what it's doing and stand up for the judicial branch and for justice," she said.
