The European Commission approved the plan today, saying its assessment had concluded there would be no adverse impact on competition in the relevant markets, owing to the combined entity continuing to face "significant competition".
The government brief adds that "in rapidly evolving technology markets, even a brief delay in effectuating remedies that will reduce Microsoft's ability and incentive to engage in anticompetitive conduct will have a serious adverse impact on competition and innovation".
Consequently, the most useful and significant thing in this week's CMA report may well prove to be the recognition that all of this constitutes an "adverse effect on competition".
Such arrangements appear to have the potential to have an adverse effect on competition through retailer acceptance of large sums of money from suppliers in exchange for better positioning or increased shelf space".
"The court finds that the government has failed to prove that the governance structures of the Visa and MasterCard associations have resulted in a significant adverse effect on competition or consumer welfare," Judge Jones said in a 157-page opinion.
A judge rejected a preliminary injunction to the Garden in November, and the appeals court released a summary judgment in March rejecting the injunction as well, saying that Madison Square Garden "did not show that the N.HL.'s Web site ban has had an actual adverse effect on competition in the relevant market".
It said it needed the extra time after taking into consideration "the further work required to develop the analyses, and the further work required to develop a suitable package of remedies that is reasonable and comprehensive in addressing any findings of adverse effects on competition in the retail banking markets for PCA customers and SMEs [small and medium sized enterprises]".
