"The officials acted with deliberate indifference by failing to protect her rights".
Shortly after Mr. Rodriguez's trial, jurors said that prosecutors had not proved that Mr. Rodriguez acted with "depraved indifference to human life," the standard for second-degree murder.
"The Defendants acted with callous indifference to the rights and duties owed to Plaintiffs, all American Rules Football leagues and players and the public at large," the lawsuit says.
Judge Eugene F. Pigott said that if the court accepted some of the defense arguments, it would be easier to prove that someone had acted with depraved indifference if they were sober.
That element is that Mr. Williams acted with extreme indifference to human life, or, as Judge Coleman wrote in his instructions, did not care if Mr. Christofi might be killed.
But they said they could not sway holdouts who believed that prosecutors had failed to offer sufficient evidence that Mr. Rodriguez acted with "depraved indifference to human life," the standard for second-degree murder in this case.
"This time, we're confident we can prove that the N.C.A.A. has impermissibly used race as a discriminatory factor and has acted with deliberate indifference by continuing to maintain Proposition 16".
They seek to prove not only that a pattern of race-based stops exist, but that department supervisors have acted with "deliberate indifference, the legal term for burying your head in the sand," Baher Azmy, legal director of the Center for Constitutional Rights, the organization which brought the lawsuit, said in an interview.
The charge of first-degree manslaughter that Noorah faced meant that prosecutors believed Noorah had acted with "extreme indifference to the value of human life". If he was convicted on the charge, he would have faced a mandatory minimum of 10 years in prison.
