Accordingly, we modify the judgment by reducing the conviction of criminal possession of a controlled substance in the third degree to criminal possession of a controlled substance in the seventh degree (see CPL 470.15 [a]; People v Smith, 74 AD3d 1250, 1250 ; People v Cotton, 226 AD226738 ).
