Some thought the court might find a potential compromise, in which the proposition would be upheld, but so would the marriages that had already taken place.
He opposed legalizing same-sex marriage in 2008, and joined five of his colleagues the following year in voting to uphold Proposition 8, the ballot measure that reinstated the marriage ban.
Part of the argument also focused on whether the four private individuals seeking to uphold Proposition 8 had the authority to bring the case to the supreme court after the California state government decided not to defend the measure.
All of which has heightened expectations for the Boies and Olson case, filed in the spring after the California Supreme Court upheld Proposition 8, which passed with 52 percent of the vote after a bruising and costly campaign.
