Nothing in subsection (h) or (i) shall be construed as precluding the availability of the records of a pilot in an investigation or other proceeding concerning an accident or incident conducted by the Administrator, the National Transportation Safety Board, or a court.
It asserted that "the executive branch shall construe [the law] in a manner consistent with the constitutional authority of the president... as commander in chief," adding that this approach would "assist in achieving the shared objective of the Congress and the president... of protecting the American people from further terrorist attacks".
Now if we wanted to construe 'perceive' narrowly, excluding any element of memory, then we would have to say that we do not, after all, perceive B as following A. But in this article, we shall construe 'perceive' more broadly, to include a wide range of experiences of time that essentially involve the senses.

On Page 51, in all capitals, it was written that homeowners shall not construe guards and gates as any representation of safety.
(i) Nothing in this section shall be construed to create a private right of action if the Lead Agency acts in accordance with the Act and this part.
In clauses (1), (4)–(7), and (9)–(12) of the revised section, the word "means" is substituted for the words "shall be construed to refer to" and "shall be construed to refer * * * to".
Nothing in this section shall be construed to apply to part C of title I of the Rehabilitation Act of 1973 (29 U.S.C. 741).
Nothing in this section shall be construed as superseding (or preventing the application of) subsection (g), (i), or (j) of section 1396o of this title.
Nothing in this paragraph shall be construed to preclude the use of multiple terms or identifiers to meet the requirements of clause (i).
