"Election fraud strikes at the very core of our democracy," he added, noting that since 1993, the Kansas secretary of state's office has investigated more than 200 cases of voter fraud, none of which, he claims, resulted in a "complete prosecution".
"When we have got a contractor city, say, of 180,000 people, and there hasn't been a completed prosecution of anybody coming out of Iraq, not one," he said, "what sort of city in America would be like that, where no one is prosecuted for anything for three years?
And before a federal indictment could be obtained, the Justice Department would have to certify that it had consulted with the local authorities, who either had no jurisdiction or intention to act, or that the state had requested or at least did not object to federal action, or that the state had completed prosecution.
(That setup has yielded hardly any completed prosecutions).
Yet, while disability hate crime convictions went up from 77% to 82% between 2012-13 and 2013-14, the number of completed prosecutions fell from 640 to 574.
"It often takes two years or more for a criminal tax defendant to be convicted and sentenced, so the increase in new cases is not yet reflected in completed prosecutions," he said.
Of those that have been completed, prosecutions have either failed – as in the case of Thomas Drake, a former NSA official against whom all 10 charges were dropped – or led to a prison term for non-Espionage Act charges, as in the case of John Kiriakou, who is serving a 30-month sentence for disclosing classified information about a fellow CIA officer.
